Merch Crew Terms & Conditions (“Terms”) govern your access to and use of our website and services (“Site”) and any purchases you make from us.

Definitions & Interpretation

“Products” means goods (merchandise) offered for sale through our Site.
“Order” means your order for Products via the Site.
“Site” means merchcrew.com.au and its subdomains.

Use of the Site
You agree not to use the Site for illegal, fraudulent or abusive purposes.
You agree not to interfere with the Site’s operation (e.g. hacking, viruses, etc.).
All content on the Site (text, images, logos, etc.) is the property of Merch Crew or licensed to us. You may not copy, republish, or exploit it without written permission.

All content and materials are owned by or licensed to Merch Crew and protected by copyright and trademark law.

Orders & Acceptance
All orders are subject to availability and confirmation. We may decline or cancel an order at our discretion (for example, stock or pricing errors).

We’ll notify you by email if your Order is cancelled or cannot be fulfilled.

Pricing & Payment
All prices are shown in Australian dollars (AUD) and include GST unless stated otherwise.
Payment is taken at time of order (or when you confirm).

Full payment is required before production or dispatch.
In the event of a pricing or listing error, we reserve the right to cancel the affected order and issue a full refund.

Price Match Promise
We aim to provide the best value for our customers. If you find the same product at a lower advertised price with a comparable delivery timeframe, we’ll do our best to beat it.

To qualify for a Price Match:

- The product must be identical in brand, specifications, decoration method, and quantity.
- The competitor must be an Australian-based supplier operating under an Australian ABN.
- The quote must include equivalent artwork setup, decoration, and delivery timeframes.
- The competitor’s offer must be current and verifiable in writing (e.g. a formal quote or website listing).
- The Price Match Promise does not apply to clearance, liquidation, promotional, or auction pricing.

Merch Crew reserves the right to verify competitor pricing and to decline a Price Match request if the above conditions are not met.

Ownership & Risk
Risk in the products passes to you upon delivery to your nominated address.
Ownership remains with Merch Crew until full payment has been received.

Consumer Guarantees
We comply with the Australian Consumer Law (ACL).
You are entitled to a repair, replacement or refund if a product has a major fault or is not as described.
This does not apply to change of mind or customer error.

We disclaim, to the fullest extent permitted by law, any liability for indirect or consequential loss arising from your use of the Site or Products, except where prohibited by applicable law

Returns & Refunds
We do not provide returns, exchanges or refunds for change of mind, incorrect selections, or customisation errors once artwork has been approved.
If your item is faulty, damaged, or not as described, please contact us within 7 days of receipt at hello@merchcrew.com with details and supporting photos.

Return shipping costs may be your responsibility in certain cases.

Limitation of Liability
Except where required by law, Merch Crew will not be liable for indirect or consequential loss arising from use of the Site or Products.

Changes to Terms
We may update these Terms at any time by posting a new version on our website.

Governing Law
These Terms are governed by the laws of New South Wales, Australia.

Third-Party Links & Services
The Site may link to third-party websites or services (e.g. social media, payment gateways). We are not responsible for their content or privacy practices.
Your dealings with third parties are solely between you and them.

Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision is to be severed, and the remainder still stands.

Dispute Resolution & Governing Law
These Terms and any disputes arising from them are governed by the laws of New South Wales, Australia.
If there is a dispute, we encourage you to contact us first to resolve amicably.
You may access consumer dispute resolution schemes (e.g. NSW Fair Trading, or a relevant ADR scheme) where applicable.
